By accessing and using this website (the "Site"), you accept the following terms and conditions of use. These terms and conditions may be updated and/or modified at any time by Comau S.p.A. ("Comau"), in its sole discretion, without prior notice to users.

Copyright and Industrial Property

Unless otherwise mentioned in the Site, all contents of the Site (e.g. news, photos, videos, sounds, marks, logos, domain names, software applications, graphic layouts, technical documentation and manuals, etc.) and their related rights are reserved by Comau and protected by copyright and other applicable laws protecting intellectual and industrial property. For any third parties’ content displayed in the Site, Comau will also display the source and any similar reference to its author/owner. The contents may be accessed and used only for informational, non-commercial purposes and may not therefore be altered, copied, reproduced, transmitted, modified or otherwise used for derivative works or other commercial purposes, in whole or in part, without the prior written consent of Comau.

Although the information and data displayed in the contents were collected and presented responsibly and accurately in this Site by Comau, no express nor implicit warranty is given to users as to the accuracy, completeness and usefulness of such information and data. User conduct

Users can access and use the functions of the Site and its contents in their discretion, in compliance with these terms and conditions and with all applicable laws and regulations. Comau assumes no liability of whatever kind in respect to access by users to this Site or in respect to the use of its contents.

In order to access the Site and its restricted sections and pages, users shall send an authentication request through a dedicated page in the Site. After reviewing the request, Comau shall issue user names and passwords granting access to the Site. User names and passwords must be kept confidential. Users may unsubscribe from the Site through dedicated unsubscribe button into their own profile page. Users acknowledge that, by clicking unsubscribe button, Comau is entitled to proceed with immediate cancellation of any and all data previously uploaded in the Site by the user, without any delay nor any further notice.

Through the Site, User may request additional business services to Comau, according to the terms and conditions specified therein, which may vary from time to time.

Users shall comply with guidelines for the creation and upload of user generated contents shown in the “Handbook” section of the Site. Any non-compliance to such guidelines, as well as to applicable laws and regulations protecting Comau’s and third parties’ rights entitles Comau to remove non-compliant contents from the Site without any previous notice and to claim any and all damages suffered as a consequence of such non-conformity.

Users acknowledge that potential customers may enquire for commercial offers through the Site and generate commercial and marketing leads. Users shall process those leads in good faith, sharing commercial information with Comau whenever appropriate. Notwithstanding what above, Comau is entitled to suspend or discontinue access of the users to the Site without previous notice, in case of unlawful or unfair use of commercial and marketing leads for personal benefit or to harm Comau’s business activity or business reputation.

Claims of Infringement

If you believe that any of the contents on the Site infringes your intellectual property rights or any third party’s rights, please send written notice to Comau containing the following information:

  1. Clear indication of “Infringement notice - Comau website” in the subject line;
  2. Identification of the protected work claimed to have been infringed, or, in case of multiple infringements, a complete list of such protected works;
  3. Identification of the content that is claimed to be infringing or to be subject of infringing activity and that is to be removed or disabled;
  4. Identification of the right holder and any contact info deemed necessary to permit Comau to contact the right holder, including address, telephone number and, if available, e-mail;
  5. Declaration stating that the use of the protected work in question has not been authorized by the right holder, by their agents or by their legal representatives;
  6. Declaration stating that the information submitted to Comau is accurate and, in the knowledge that criminal penalties will be incurred in the event of false declarations, that they are in possession of authorization to act on behalf of the holder of the infringed right(s);
  7. Signature, real or electronic, of the person authorized to act on behalf of the right holder.

Applicable law and jurisdiction

Without prejudice to any other rights that users benefit from by virtue of other national or international laws, these terms of use are subject to and will be construed in accordance with Italian laws. In case of any dispute over the existence, validity and enforceability of these terms of use, the court of Turin (Italy) shall have exclusive jurisdiction.

PURPOSE AND PROCEDURE FOR THE PROCESSING OF PERSONAL DATA

The personal data you have provided (“Data”) will be processed for the following purposes:

  • providing the requested service ("Service”) according to the agreement between you and Comau  S.p.A. (“Company”);
  • allowing the Company to perform surveys on customers satisfaction (“Customer Satisfaction”) related to the quality of Company goods and services according to the Company legitimate interest;
  • subject to your express consent, sending commercial communications as well as sending advertising on Company products and services, or performing market researches (“Marketing”);
  • subject to your express consent, analyzing your behaviors, habits and propensity to consume to enhance products and services provided by the Company as well as satisfy your expectations (“Profiling”);
  • subject to your express consent, communicating Data to Company subsidiaries and affiliates, as well as their partners in the automotive, financial, insurance and telecommunication sectors, that will process them to send commercial communications as well as advertising on their products and services, or perform market researches (“Marketing third Party”).

The Data may be processed in hardcopy, by automated or electronic means including via mail or e-mail, phone (e.g. automated phone calls, SMS, MMS), fax and any other mean (e.g. web sites, mobile apps).

CONSEQUENCES OF FAILURE TO PROVIDE THE DATA

Submitting the Data is never mandatory. However, not providing the Data marked as mandatory will prevent the Company from providing the Service. On the other hand, not providing the optional Data will allow you to access the Service anyway.

RECIPIENTS OF THE DATA

The Data may be processed by natural persons and/or legal entities, acting on behalf of the Company and under specific contractual obligations, based in EU Member States or in countries outside the EU.

The Data may be communicated to third parties to comply with legal obligations, to execute Public Authorities orders or to exercise a Company right before judicial authorities.

DATA TRANSFER OUTSIDE OF THE EEA

Within its contractual relations the Company may transfer the Data in countries outside of the European Economic Area (EEA), including store them in databases managed by entities acting on behalf of the Company. Databases management and Data processing are bound to the purposes of the processing and are carried out according to applicable data protection law.

In case the Data are transferred outside of the EEA the Company will use any appropriate contractual measures to guarantee an adequate protection of the Data including – among the others – agreements based on the standard contractual clauses adopted by the EU Commission to rule the transfer of personal data outside of the EEA.

DATA RETENTION

The Data processed to provide the Service and the Customer Satisfaction will be kept by the Company for the period deemed strictly necessary to fulfil such purposes. Concerning the Data processed for the provision of the Service, the Company may continue to store these Data for a longer period, as may be necessary to protect Company’s interests related to potential liability related to the provision of the Service.

Data processed for Marketing and Profiling purposes will be kept by the Company from the moment you give consent until the moment you withdraw the consent. Once consent is withdrawn, Data will no longer be used for these purposes, although they may still be kept by the Company, in particular as may be necessary to protect Company’s interests related to potential liability related to this processing unless further clarification are provided by the competent Supervisory Authority in this regard.

YOUR RIGHTS

You can exercise the following rights:

  1. right to access means the right to obtain from the Company whether your Data are being processed and, where applicable, have access to them;
  2. right to rectification and right to erasure means the right to obtain the rectification of inaccurate and/or incomplete Data, as well as the erasure of Data when the request is legitimate;
  3. right to restriction of processing means the right to request suspension of the processing when the request is legitimate;
  4. right to data portability means the right to obtain Data in a structured format, ordinary used and readable, as well as the right to transfer Data to other controllers;
  5. right to object means the right to object to the processing of Data when the request is legitimate, including when the Data are processed for marketing or profiling, if applicable;
  6. right to lodge a complaint with a supervisory authority in case of unlawful processing of Data.
